Terms of Service

1. Service Overview

photoclaw (“we”, “us”, “our”) provides an AI-powered avatar generation service. You purchase credits, select a style, and we generate unique avatar images using artificial intelligence. Each generated avatar receives a permanent public URL.

2. AI-Generated Content Disclosure

All avatars generated through photoclaw are created using artificial intelligence (Google Gemini). The images are AI-generated and should not be represented as human-created artwork. We encourage users to disclose the AI-generated nature of these images where appropriate.

3. Credits & Payments

• Credits are purchased in packs via one-time payments.
• Credits never expire and are non-transferable.
• 1 credit = 1 avatar generation.
• If a generation fails, your credit is automatically refunded.
• Purchased credits are non-refundable except as required by applicable law. Contact us for exceptional circumstances.
• All payments are processed securely through Stripe.

4. Ownership & Usage Rights

You own the avatars you generate. You may use them for any purpose, including commercial use — in your products, websites, applications, documentation, or social media profiles. We retain no rights to your generated images.

5. Avatar URLs

Each generated avatar receives a permanent public URL. These URLs are intended to remain accessible indefinitely. However, we reserve the right to remove content that violates these terms. We are not liable for temporary service interruptions.

6. Prohibited Use

You agree not to use photoclaw to:

• Generate content depicting real people without consent.
• Create misleading, deceptive, or fraudulent content.
• Abuse, overload, or interfere with the service.
• Resell credits or generated images as a competing service.

7. Account Termination

We may suspend or terminate accounts that violate these terms. Unused credits may be forfeited upon termination for cause. You may delete your account at any time through your settings.

8. Limitation of Liability

photoclaw is provided “as is” without warranties. We are not liable for indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

9. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the new terms. We will notify users of material changes via email or in-app notice.
